These Terms and Conditions govern your use of the Winnersbet.co wagering platform operated by Winnersbet Pty Ltd.

Introduction

These Terms govern your use of Winnersbet.co wagering services. By creating an account, you agree to be bound by these Terms. Winnersbet.co is operated by Winnersbet Pty Ltd (ABN 12 641 753 942, ACN 641 753 942), located at 7A Steel Street, Spotswood, Victoria 3015, Australia. Winnersbet Pty Ltd operates under licence VIC-BM-2024-1185 and is regulated in Victoria by the Victorian Gambling and Casino Control Commission (VGCCC).

These Terms should be read together with our Privacy Policy, Cookie Policy, Responsible Gambling information and any sport- or racing-specific rules published on the Platform, all of which form part of the agreement between you and Winnersbet Pty Ltd. If you do not agree with these Terms you must not register an account or use the Services.

Definitions

'Account' means your Winnersbet.co wagering account. 'Services' means the wagering and related services offered through the Platform. 'We', 'us' and 'our' refer to Winnersbet Pty Ltd. 'You' and 'your' refer to the account holder. 'Platform' means the Winnersbet.co website and any associated applications. 'Bet' or 'Wager' means a bet placed through the Services and recorded as accepted by the Platform. 'Event' means any sporting, racing or other event on which wagering is offered. 'Market' means a set of outcomes offered for wagering on an Event. 'Obvious Error' means an error in odds, prices, participants, markets, settlement or technical operation that is clearly incorrect to a reasonable person. 'BetStop' means the Australian National Self-Exclusion Register. 'Verification' means the identity, age, address, payment method or source-of-funds checks described in these Terms.

Eligibility

You may open an Account and use the Services only if you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are acting in your own name and on your own behalf and not for or on behalf of any other person.

You must be physically located in a jurisdiction where the use of the Services is lawful at the time you access the Platform and place a Wager. It is your responsibility to ensure that your use of the Services complies with the laws applicable to you, and you must comply with any geographic restrictions we apply. We may use location, device and other data to verify your location and may restrict or refuse access where lawfulness cannot be established.

You must register and operate your Account using your own accurate personal details and must not use the identity, documents or payment methods of any other person.

You must not be registered with BetStop or subject to any other self-exclusion, time-out or exclusion order applied by us or by a regulator. Where we identify that you are excluded, your Account will be closed or suspended in accordance with these Terms.

You must not place a Wager on an Event where you are a participant, official, employee, agent or otherwise a prohibited person under the rules of the relevant sporting or racing body, or where you hold inside information about that Event. We may void Wagers and close Accounts where this eligibility condition is breached.

Account Registration

To use the Services you must register an Account and provide your full legal name, date of birth, residential address, email address, mobile number and any other information we reasonably require. You warrant that all information provided is true, complete and accurate.

Each customer may maintain only one wagering account unless otherwise approved by Winnersbet Pty Ltd. Accounts are personal and must not be transferred, sold, shared or operated on behalf of another person. Registering an Account in the name of, or on behalf of, another person is prohibited.

You must ensure that all registration and account information remains complete and accurate and must promptly update us if your personal or contact details change, including any change of residential address, email address or telephone number.

We may require identity, age, address, payment method or source-of-funds verification before permitting wagering, deposits or withdrawals, or at any other time where required by law or reasonably necessary for security and compliance purposes. We may request additional documents or information and may restrict Account functionality until Verification is complete.

You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your Account using those credentials, whether or not authorised by you. If you know or suspect that your credentials have been lost, stolen or compromised, or that your Account has been accessed without authorisation, you must notify us immediately through the Contact Us page. We may suspend the Account, reset credentials and review recent activity while we investigate a suspected compromised Account.

You may request closure of your Account at any time through the Contact Us page. Closure is subject to settlement of outstanding Wagers and completion of any required Verification, as described further in the Suspension and Closure section.

Identity Verification and Compliance

We are required by law, including anti-money laundering and counter-terrorism financing legislation and Victorian wagering regulation, to verify the identity of our customers. Verification may include identity verification against government-issued documents and independent data sources, age verification, verification of your residential address, and verification that any payment method used belongs to you.

Where reasonably required for compliance or risk purposes we may also request information or documentation about your source of funds or source of wealth, and any additional documentation necessary to complete or refresh Verification. You agree to provide requested information promptly.

Until Verification is completed to our reasonable satisfaction we may restrict deposits, wagering, promotions or withdrawals, and we may suspend the Account if Verification cannot be completed within the period required by law or by us.

We monitor Account activity and transactions and may review, delay or decline any transaction that we reasonably consider suspicious, unusual or inconsistent with your Account profile. Where required by law we may report transactions or activity to the relevant authorities without notice to you.

Deposits and Withdrawals

Deposits may be made using the payment methods displayed on the Platform from time to time, which may include debit cards and other approved Australian payment methods. Credit cards are not accepted. Any payment method used for deposits or withdrawals must be issued in your own name and belong to you as the Account holder. Payments from or to third-party payment methods are prohibited and may be reversed, and the associated Wagers may be voided.

Minimum and maximum deposit and withdrawal amounts may apply and will be displayed on the Platform or advised to you. Deposited funds are held for the purpose of wagering only; we do not pay interest on Account balances and do not offer credit.

You may withdraw your cleared Account balance at any time, subject to the completion of Verification, the settlement of any outstanding Wagers and any applicable turnover conditions attached to promotional funds. Withdrawals are generally processed within 1–3 business days of approval; the time taken for funds to appear in your account may depend on your financial institution.

Where possible, withdrawals will be returned to the payment source used for the deposit. Where this is not possible, withdrawals will be paid to a bank account or other approved payment method held in your name.

We may temporarily delay a withdrawal while conducting identity, security, fraud, anti-money laundering or other compliance checks where reasonably required. Funds will not be withheld permanently except where permitted or required by law or these Terms.

You must not initiate a chargeback, payment reversal or dispute with your financial institution in respect of a legitimate deposit. Where a chargeback or reversal occurs we may recover the amount from your Account balance, void Wagers funded by the reversed payment and suspend or close the Account. Any amount credited to your Account in error, including funds paid to you by mistake, must be returned and may be debited from your Account.

On closure of your Account the remaining cleared balance will be returned to you, subject to Verification and these Terms. Promotional or bonus balances that have not met their conditions are forfeited on closure.

Placing Bets

All Wagers are subject to these Terms, the applicable sport- or racing-specific rules published on the Platform and the rules of the relevant governing body. A Wager is placed only when you submit a bet request through the Platform, and a Wager becomes binding on both parties only once the Platform records and confirms its acceptance and the Wager appears in your Account transaction history.

Before submitting a bet request you must check your selection, the stake and the odds. Once a Wager has been accepted it cannot be cancelled or amended by you, and you are responsible for any Wager placed through your Account.

Odds are subject to change until a Wager is accepted. We may, acting reasonably, refuse to accept all or part of any bet request, apply minimum and maximum stake limits, and apply maximum payout limits for individual Wagers, Events or customers. Applicable limits are published on the Platform or notified to you before or at the time of acceptance.

Where identical bet requests are submitted more than once in a short period, or where we reasonably determine that a duplicate submission resulted from a technical fault or repeated clicks, we may void the duplicate Wagers and refund the stakes.

Wagers placed after an Event or Market has commenced, been suspended or closed, or where the outcome was known or reasonably knowable at the time the Wager was placed, may be voided. Where an Event starts earlier than the scheduled time, Wagers placed after the actual start will be void unless the applicable rules provide otherwise.

Errors and Incorrect Odds

We take reasonable care to publish accurate odds, prices, markets and participant information. However, errors can occur, including human error, technical faults and errors in information received from data, feed and pricing providers.

Where a Wager has been accepted at odds or terms that were materially incorrect at the time of acceptance as a result of an Obvious Error, or where a Market, participant, name, line or handicap has been displayed incorrectly, we may void the Wager and refund the stake, or where reasonable, settle the Wager at the correct odds or terms that were available at the time it was placed.

You must not knowingly take advantage of an obvious pricing, odds, settlement or technical error. Where we reasonably determine that you have done so, we may void the affected Wagers, recover any amounts paid in error and suspend or close your Account.

Where a Wager has been settled incorrectly, including where an incorrect result has been entered or a result is subsequently corrected by the governing body, we may correct the settlement, and we may credit or debit your Account accordingly. We will notify you of any material settlement correction.

Abandoned, Postponed and Rescheduled Events

Where an Event is abandoned before completion and no official result is declared, all Wagers on that Event will be void and stakes refunded, except for Markets that have already been unconditionally determined at the time of abandonment, which will be settled in accordance with the applicable rules.

Where an Event is postponed or rescheduled, Wagers will stand where the Event is completed within the period specified in the applicable sport- or racing-specific rules (generally 48 hours of the original scheduled start time for sporting events and the same race meeting for racing). Where the Event does not take place within that period, or is moved to a different venue in circumstances where the applicable rules provide for voiding, Wagers will be void and stakes refunded.

Where a participant is withdrawn or scratched before the start of an Event, Wagers on that participant will be void and stakes refunded, and deductions may be applied to winning Wagers in accordance with the applicable racing rules. Where a participant is listed incorrectly, or a Market is offered in respect of the wrong participant or fixture, we may void Wagers on that Market.

Markets may be suspended at any time, including in response to significant events, injury, team changes or technical issues. Bet requests received while a Market is suspended will not be accepted.

Results and Settlements

Wagers are settled on the official result declared by the relevant governing body or racing authority at the conclusion of the Event, in accordance with the applicable sport- or racing-specific rules. We will make reasonable efforts to settle Wagers promptly after the official result is available. Settlement may be delayed where a result is subject to a protest, inquiry, appeal or other official review.

Our initial settlement determination will apply unless it is subsequently amended following a review, official correction or the applicable complaints and dispute resolution process. Subsequent changes to a result made by a governing body after settlement (for example, on appeal or following a disciplinary process) will not generally affect settlement unless the applicable rules provide otherwise.

Dead heat rules apply where two or more participants share a finishing position. In a dead heat the stake is divided by the number of participants sharing the position, and the divided stake is paid at the full odds; the remainder of the stake is lost.

Maximum payout limits may apply. Where the total return on a Wager would exceed the applicable limit, the payout will be capped at that limit.

Cancellation and Voiding

We may cancel or void a Wager, in whole or in part, where: the Wager was accepted as a result of an Obvious Error or technical fault; there is reasonable evidence of fraud, collusion, match-fixing or other conduct affecting the integrity of the Event or the Services; the Event has been abandoned, cancelled or not completed within the applicable period; the Wager was placed after the Event or Market commenced or was suspended; the Wager was placed in breach of these Terms, including by a person who is ineligible, excluded or operating multiple Accounts; the Wager was funded by a reversed or unauthorised payment; or we are directed or required to do so by a regulator, governing body or applicable law.

Where a Wager is voided the stake will be returned to your Account, except where the stake was funded by a reversed payment or where we are entitled or required by law to withhold it. Where a Wager forms part of a multi or combination bet and one leg is void, that leg will be treated as a winning selection at odds of 1.00 and the remaining legs will stand.

Technical Errors and Service Availability

We aim to make the Platform available at all times, but we do not guarantee uninterrupted or error-free access. The Platform may be unavailable, in whole or in part, for maintenance, upgrades, security reasons, technical faults or circumstances beyond our reasonable control. We are not responsible for your inability to place or cash out a Wager because the Platform or your connection to it was unavailable.

A wager is not accepted merely because a bet request has been submitted. A wager becomes valid only when the Platform records and confirms its acceptance. If your connection is interrupted after you submit a bet request, you should check your Account transaction history to confirm whether the Wager was accepted before submitting it again. Wagers recorded as accepted by the Platform will stand; bet requests that were not recorded as accepted are not Wagers and are not binding on either party.

Where a technical fault results in the same bet request being recorded more than once, we may void the duplicate Wagers and refund the stakes. Where information displayed on the Platform (including scores, times, statistics, participant details or odds) is incorrect as a result of a technical error, latency or an error by a data, feed or pricing provider, Wagers may be dealt with in accordance with the Errors and Incorrect Odds section. Displayed live information is provided for guidance only and is not relied upon for settlement.

You are responsible for your own device, software and internet connection and for ensuring that they are secure and suitable for accessing the Platform.

Responsible Gambling

We are committed to providing our Services responsibly and in accordance with the Victorian Responsible Gambling Code of Conduct. The following tools are available through your Account and on request through the Contact Us page: deposit limits (daily, weekly or monthly limits on the amount you can deposit; decreases take effect immediately and increases take effect after a cooling-off period), activity statements and reminders, a temporary break (time-out) from wagering for a period you choose, and permanent self-exclusion from Winnersbet.co.

You may also register with BetStop, the National Self-Exclusion Register, to exclude yourself from all licensed Australian online wagering providers, including Winnersbet.co, for a period of your choosing or permanently. Details are available on our BetStop page and at betstop.gov.au.

During any period of time-out or self-exclusion you must not attempt to open a new Account, use another person's Account or otherwise access the Services. Any Wagers placed in breach of an exclusion may be voided and winnings withheld to the extent permitted by law. You must not attempt to circumvent deposit limits, time-outs, self-exclusion or any other responsible gambling control applied to your Account.

Intellectual Property

All content on the Platform, including text, graphics, logos, software, odds, data and the compilation of that content, is the property of Winnersbet Pty Ltd or its licensors and is protected by copyright, trade mark and other intellectual property laws. You may use the Platform for your personal, non-commercial use only. You must not reproduce, distribute, scrape, modify or commercially exploit any content without our prior written consent.

Privacy

We collect, use, disclose and store personal information in accordance with our Privacy Policy, which forms part of these Terms. By registering an Account and using the Services you acknowledge that your personal information will be handled as described in the Privacy Policy, including disclosure to regulators, racing and sporting bodies, identity verification providers and BetStop where required.

Prohibited Conduct

You must not, and must not attempt to, engage in any of the following conduct in connection with the Services:

  • Opening or operating more than one Account, or operating an Account in the name of or on behalf of another person, or allowing another person to use your Account.
  • Using a payment method that does not belong to you, or using stolen, cloned or otherwise unauthorised financial instruments.
  • Providing false, misleading or incomplete information, using another person's identity or documents, or otherwise engaging in identity fraud.
  • Initiating chargebacks or payment reversals on legitimate deposits, or otherwise abusing payment processes.
  • Abusing promotions, bonuses or offers, including by opening multiple Accounts, colluding with other customers or acting contrary to the spirit of a promotion's terms.
  • Colluding with other customers, or acting in concert with others, to obtain an advantage or to circumvent stake, payout or Account limits.
  • Using bots, scripts, automated tools, scraping software or any other unauthorised means to access the Platform, place Wagers or extract data.
  • Knowingly taking advantage of an obvious pricing, odds, settlement or technical error.
  • Interfering with, manipulating or attempting to gain unauthorised access to the Platform, its software, systems or data, or introducing malicious code.
  • Using the Services for money laundering, terrorism financing or any other unlawful purpose, or depositing funds derived from unlawful activity.
  • Placing Wagers on behalf of another person, or accepting Wagers from another person, whether or not for reward.
  • Attempting to circumvent deposit limits, time-outs, self-exclusion, BetStop registration or any other responsible gambling control or Account restriction.
  • Engaging in, facilitating or benefiting from match-fixing, race-fixing, spot-fixing, the use of inside information or any other conduct affecting the integrity of a sporting or racing Event.
  • Placing Wagers on an Event in which you are a participant, official or otherwise a prohibited person under the applicable rules.
  • Any other conduct that is unlawful, fraudulent, abusive towards our staff or other customers, or detrimental to the integrity or reputation of the Services.

Prohibited Conduct — Consequences

Where we reasonably determine that you have engaged in Prohibited Conduct we may take any one or more of the following actions: void affected Wagers and withhold associated winnings; recover amounts paid in error or obtained through the conduct; suspend or permanently close your Account; forfeit promotional balances; report the conduct to the VGCCC, law enforcement, sporting and racing integrity bodies or other relevant authorities; and take legal action. We may also share information about the conduct with other wagering operators and integrity bodies where permitted or required by law.

Suspension and Closure

Closure by you. You may request closure of your account at any time, subject to settlement of outstanding wagers and completion of any required verification. Account closure does not affect wagers validly accepted before closure unless those wagers are otherwise void under these Terms. Once outstanding Wagers are settled, your remaining cleared balance will be returned to you.

Suspension by us. We may suspend your Account, or restrict some of its functions, where we reasonably suspect a breach of these Terms, fraud, Prohibited Conduct or a security compromise; where Verification is incomplete or documents are outstanding; where required for a compliance, integrity or fraud investigation; or where directed by a regulator or governing body. We will notify you of a suspension and, where appropriate, the steps required to restore access. During suspension you will not be able to place Wagers, deposit or withdraw, although we may allow withdrawal of a verified balance at our discretion.

Permanent closure by us. We may permanently close your Account where you have materially or repeatedly breached these Terms, provided false information, engaged in fraud or Prohibited Conduct, where required by law or regulatory direction, or on 30 days' notice for any other reason. Where an Account is closed following an investigation, we may withhold amounts that we are entitled or required by law to withhold, and will return the remaining verified balance.

Self-exclusion and BetStop. Where you self-exclude with us or register with BetStop, your Account will be closed for the period of the exclusion, unsettled Wagers will be settled in the ordinary course and any resulting balance returned to you, and you will be removed from marketing communications. We will not accept a new Account from you during the exclusion period.

Unsettled Wagers and promotional balances. Except where these Terms provide for voiding, Wagers accepted before closure or suspension will be settled in the ordinary course and winnings credited to your Account for withdrawal. Promotional or bonus balances and any pending bonus bets that have not met their conditions at closure are forfeited.

Inactive Accounts

Your Account will be considered inactive if no Wager, deposit or withdrawal has been made and you have not logged in for a continuous period of 12 months. Before an Account becomes inactive we will attempt to contact you using the email address and telephone number registered to your Account to remind you of your balance and the options available to you.

Where an Account remains inactive and holds a balance, we will attempt to return the balance to your verified payment method or nominated bank account. Where we are unable to do so after reasonable attempts to contact you, the balance will continue to be held on your behalf and will be dealt with in accordance with applicable unclaimed money legislation.

We do not charge dormancy, inactivity or administrative fees on inactive Accounts. You may reactivate an inactive Account at any time by contacting us and completing any Verification required.

Customer and Operator Responsibilities

You are responsible for ensuring that your account information is accurate, maintaining the confidentiality of your login credentials, reviewing wager details before submission and complying with these Terms and applicable law. You are also responsible for all activity conducted through your Account, for the security of the devices you use to access the Platform and for ensuring that your use of the Services is lawful in your location.

Winnersbet Pty Ltd is responsible for administering accepted wagers, maintaining customer account records, processing withdrawals subject to verification requirements and providing the Services in accordance with applicable wagering laws and regulatory requirements. We are also responsible for holding your Account balance in accordance with our licence conditions, providing the responsible gambling tools described in these Terms, handling your personal information in accordance with our Privacy Policy and dealing with complaints in accordance with our complaints handling procedures.

Each party remains responsible for loss caused by its own fraud, wilful misconduct or breach of applicable law. Nothing in these Terms excludes or limits any responsibility that cannot be excluded or limited under the Australian Consumer Law or other applicable legislation.

Limitation of Liability

To the extent permitted by law, our total aggregate liability to you in connection with the Services, whether in contract, tort (including negligence), statute or otherwise, is limited to the balance of your Account at the time the relevant event occurred, or the amount of the relevant Wager, whichever is greater.

To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profit, revenue, opportunity or data, or for any loss arising from unavailability of the Platform, interruption of your connection, errors in information supplied by third-party data or feed providers, or events beyond our reasonable control. Nothing in this section limits our liability for our own fraud, wilful misconduct or breach of applicable law, or excludes any guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.

Disputes and Complaints

How to lodge a complaint. If you have a complaint about the Services, a Wager, a settlement, a payment or the handling of your Account, you should lodge it with us in the first instance through the Contact Us page, by email to support@winnersbet.co or by calling our support line. Complaints should be lodged as soon as reasonably practicable after the matter arises.

Information required. To help us investigate, please include your full name and Account email address, the date and time of the matter, the Wager reference or transaction reference where relevant, a description of the issue and the outcome you are seeking, and any supporting information such as screenshots.

Internal review. We will acknowledge your complaint promptly and will investigate complaints in accordance with our applicable complaints handling procedures and regulatory obligations. We may request further information from you during the investigation.

Written response. We will provide you with a written response setting out the outcome of our investigation and the reasons for our decision, normally within 21 days of receiving your complaint. Where more time is required we will inform you of the reason and the expected timeframe.

Escalation. If you are not satisfied with the initial response you may ask for the complaint to be escalated for review by a senior staff member not involved in the original decision. We will provide a further written response following that review.

External review. If you remain dissatisfied after our internal process has been completed, you may refer the matter to the Victorian Gambling and Casino Control Commission (VGCCC), which regulates our licence, or to another external dispute resolution body or court of competent jurisdiction. Information on lodging a complaint with the VGCCC is available at vgccc.vic.gov.au. Nothing in these Terms prevents you from contacting a regulator directly.

Changes to Terms

We may amend these Terms from time to time, including to reflect changes in law, regulatory requirements or our Services. We will publish the updated Terms on the Platform with a revised effective date and, for material changes, will notify you by email or by notice on the Platform before the changes take effect. Changes will not apply to Wagers accepted before the effective date of the change. Your continued use of the Services after the effective date constitutes acceptance of the amended Terms. If you do not agree with a change, you should stop using the Services and may request closure of your Account.

Tax

You are responsible for obtaining independent advice regarding any taxation obligations that may apply to your individual circumstances. Winnersbet Pty Ltd may provide information to taxation or other government authorities where required by law.

Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms where that failure or delay results from circumstances beyond our reasonable control, including natural disasters, fire, flood, war, terrorism, civil unrest, pandemic, government action or regulatory direction, industrial disputes, failure of power, telecommunications or internet services, or failure of third-party data, feed or payment providers.

Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.

Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision will be severed or read down to the extent necessary, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Responsible Gambling information, any promotion-specific terms and the sport- and racing-specific rules published on the Platform, constitute the entire agreement between you and Winnersbet Pty Ltd in relation to the Services and supersede any prior agreements or representations.

Assignment

We may assign or novate our rights and obligations under these Terms to a related body corporate or to a successor licensee without your consent, provided that your rights under these Terms are not materially reduced. You may not assign or transfer your Account or any of your rights or obligations under these Terms without our prior written consent.

Waiver

A failure or delay by either party in exercising any right or remedy under these Terms does not constitute a waiver of that right or remedy, and no single or partial exercise of a right prevents its further exercise.

Notices

We may give you notice by email to the address registered to your Account, by message within your Account or by posting a notice on the Platform. Notices are taken to be received when sent or posted. You may give us notice through the Contact Us page or by email to support@winnersbet.co. It is your responsibility to keep your contact details up to date.
